G.S. v. Acadia Healthcare Company, Inc.
This was a child sexual abuse case against Acadia Healthcare Company, Inc. Acadia owns residential treatment centers across the country. In New Mexico, it owned Desert Hills. Desert Hills managed and controlled Familyworks, Inc., a nonprofit corporation that was licensed by the State of New Mexico to be a treatment foster care agency.
Familyworks placed 7-year old G.S. in a foster home, despite having notice of prior allegations of sexual abuse of children against one of the foster parents, Clarence Garcia. Garcia repeatedly raped G.S., and multiple other foster children who were placed in the home.
The lawsuit was filed in 2019. During litigation, we learned that Familyworks had falsified records it provided to the state. Evidence of this fraud was contained on a computer server that Acadia maintained and controlled. Despite the court ordering Acadia to preserve and produce the evidence, Acadia destroyed the evidence, destroying 23 95-gallon containers of paper. The court struck Acadia’s answer as to liability.
Trial began on June 27, 2023, and ended on July 7, 2023. The jury returned a verdict of $485 million, broken down as follows:
$80 million compensatory damages
$250 million punitive damages against Acadia Healthcare Company, Inc.
$75 million punitive damages against Youth & Family Centered Services, Inc., d/b/a Desert Hills

This was an insurance bad faith trial in Denver, Colorado stemming from the bad faith denial of a workers’ compensation claim. Colorado is one of two states in the country that allow for workers’ compensation insurance bad faith claims.
Our client, Fermin Salguero, was a painter who sustained significant injuries, including a severe traumatic brain injury, when he fell approximately 16 feet from a ladder while working. Fermin made a timely workers’ compensation claim but the insurance company, NorGUARD Insurance Company denied the claim, without a factual basis to do so.
The insurance company first argued that Fermin was not an employee of the insured company, even though the insurance company’s own investigator confirmed that Fermin was an employee. Because of the claim denial, Fermin was denied immediate inpatient rehabilitation treatment that would have helped improve his neurological impairments.
Trial began on March 31, 2025, and jury returned a verdict for Fermin on April 9, 2025, in the amount of $145,260,000, as follows:

Espana v. Republic Silver State Disposal, Inc. d/b/a Republic Services. In 2017, Jazmin Espana was walking home from school and was run over and killed by a Republic Services garbage truck while crossing the street in a marked crosswalk on a walk signal. Jazmin’s mom, Encarnacion, brought the lawsuit. Trial took place in August 2021.
The jury found the Republic Services defendants to be 73% at fault and returned a verdict in the amount of $38,750,000. The verdict was broken down as follows:
$26 million for past grief, sorrow and loss of companionship, society, comfort and consortium
$12 million for future grief, sorrow and loss of companionship, society, comfort and consortium
$750,000 for past damages for Jazmin’s suffering
$14,622.58 for funeral expenses

This was a wrongful death case in Oregon. Erric Gilbert went to Portland Clinic for a routine colonoscopy because he was having stomach pain. An anesthesiologist administered general anesthesia for the procedure. The colonoscopy was performed but Erric did not wake up from the anesthesia. He stopped breathing and his heart stopped. The medical staff did not properly respond to this emergency and Erric ultimately passed away.
Trial took place in 2024 in Oregon. The jury found the Portland Clinic to be negligent and returned a verdict in favor of Erric’s family as follows:

This case involved an improperly maintained swingset in an HOA community in Las Vegas. 15-year old Carl Thompson was visiting friends in the community and sat on a swing on the swingset. The beam holding the swings had worn over time and collapsed when Carl sat on the swing. The 42-pound beam hit Carl in the head, causing a significant skull and brain injury. Trial took place in February 2018. The jury returned a verdict of $20 million for Carl:

This case involved a defective sport UTV (an offroad recreational vehicle). Julio Cerna purchased the Hisun Strike 1000 UTV from L&K Enterprises, Inc. d/b/a B2B Truck Sales. About a year later, Julio was driving the UTV at the Oceano Dunes in Pismo Beach, CA. One of the dunes had significant dropoff. As the UTV crested the dune, it fell off the dropoff and rolled. The seatbelts in the UTV did not properly restrain Julio and at the same time, the rollover protection system (ROPS) collapsed as the UTV rolled. This caused Julio to slam into the ground head-first, causing a severe spinal injury that rendered him quadriplegic.
Trial took place in late 2023 in Modesto, CA. The jury found the UTV to be defectively designed but also found Julio to be 50% at fault. The jury awarded the following damages:

Kelly Hendrickson v. Lowe’s Home Centers, LLC
This was a slip and fall case in the outside garden center of a Lowe’s in Las Vegas. Lowe’s had a policy of watering plants in the garden center but not blocking walkways where they watered and not cleaning up the water. As Kelly Hendrickson was walking through the garden center, she took a step past some planters and stepped on a puddle of water she couldn’t see, causing her to fall. Kelly hit the back of her head on the ground and fractured the back of her skull. This resulted in a permanent brain injury and the loss of taste and smell. Trial took place in March 2016. The jury returned a verdict of $16,400,000, and placed 80% of the blame on Lowe’s. The verdict was broken down as follows:

Thunder Roybal v. SHAC, LLC d/b/a Sapphire LV Gentlemen’s Club
This was a case where a limousine driver for a gentlemen’s club was driving in downtown Las Vegas. He tried to pass some bicyclists but did not leave enough room and ran over one of the bicyclists, Thunder Roybal. Thunder suffered significant back injuries that resulted in almost his entire spine fusion surgery. Trial took place in May 2022. The jury found the Sapphire defendants 100% at fault and returned a verdict for Thunder for $14,126,607.74.
